Artist rights
Terms of service for commissions

General Terms

Art must be credited to the artist in a reasonable location leading to the artist.

Projects that require a strict deadline may be subjected to a priority fee and rush fee.

Artwork is for personal use only, unless paid for commercial purposes. The commissioner can display the artwork on social media and streaming platforms, properly credited to the artist, as long as it is not tied to the commissioner's profit unless stated otherwise.

Fully agreed upon payment must be received upfront before any work has begun. If payment is not received within seven days of contact. the slot will be forfeited.

Each tier of work has a base price, which may vary based on complexity, additional props, characters, or complex backgrounds. Please consult the artist before finalizing the initial transaction.

ALL NDA PROJECTS will be subjected to an NDA fee. NDA fees will be discussed during the consultation phase.

NO NFT REQUESTS. I do not consent to my artwork being used for blockchain technology, AI training, or filtering.

Undisclosed usage of artwork for NFTs, Crypto, or AI Machines results in blacklisting, severed communication, revoked rights, and potential legal action.

Write politely and clearly in the commission form. Keep it concise and prepare references, a detailed physical description, and a brief backstory paragraph if needed.

Without prior conversation, if you submit a commission form of work not available, your inquiry will automatically be denied.

The artist will strive to communicate and meet the commissioner's goals, but dissatisfaction with the final results does not qualify for refunds.
I, the artist, hold every right to the produced drawing, not the client, I'm allowed to use the copyrighted artwork to:

Promote myself within any place or site

Publishing any format
-
Display anywhere
-
Post whenever
The client is allowed to:

Unless discussed otherwise, the client agrees that this is strictly for personal use and does not have the right to reproduce the artwork for any profit whatsoever.

Claim the right of their character(s), but not the drawing itself.

Use the art to promote themselves on social media with proper credit given to the artist.
The list below is a non-exhaustive description of what the client may not use the work for:

Not allowed to use the artwork in the selling, auctioning, or raffling of adoptable.

Under no circumstances may the artwork now or anytime in the future be used for anything related to the sale or production of NFTs, Crypto, or AI-generated materials/training.

Cannot resell the artwork

May not personally alter the artwork at any time or pay for a third party to alter the artwork.

The client is not allowed to use the artwork for commercial purposes unless agreed upon and paid for as outlined in the commercial rights section.

Commercial
Rights

I have full rights to seek legal action if my copyright has been infringed.

If desired, a Purchase of Commercial rights can be discussed with the artist and will come with a fee and contract.

If commercial rights are desired, the client and I will discuss use and fees.

I.e. Situations, where commercial use would be required, would be during a sale of merchandise, using the artwork to promote a business or event, etc.

Credit is always required for the usage of the artwork in any medium regardless of whether or not commercial rights have been acquired.

Social media presence is part of my business. This means I will still be creating, streaming, & posting personal artwork as i work on your commission unless an NDA is discussed/agreed on.

Please be considerate of the artist. Once the artwork has begun, works in progress
-
(WIPs) will be given daily when necessary for feedback via DMs.

I reserve the right to decline any commission request for any reason without question.

I retain copyright to the commissioned work unless discussed otherwise.

I reserve the right to use, publish, live stream, and record the commissioned artwork/ process to share and promote on social media unless discussed otherwise.

Customer
SATISFACTION

I want to be able to create the vision of the client and complete it to the best of my abilities.

Will allow up to three minor revisions to the art piece BEFORE the layering process (final phase).

Any major revisions will be an added fee.
-
The estimate of art completion is two to six weeks. But may vary depending on the complexity or the commission type.

If a piece is needed on a deadline that I deem as a rushed commission, an additional fee will be communicated with the client and applied to the total.

Payment process

Payment will be made using Paypal in USD.
-
Payment can be the whole amount or divided in half: the first half to start, and the second half when completed. You will only receive the final once the final payment is made.

Rights may be transferred as discussed beforehand for commercial use in addition to the original cost.

Payments will be initiated via an invoice sent to the client by myself.

Cancellation
& Refund policy

I reserve the right to cancel and refund a commission for any reason.

A 93% refund is only available if you have paid the invoice, and the canceled commission has not been started. I retain 7% of the payment as a convenience fee.

Canceled commissions that are fully completed or that have reached the coloring stage will not be subject to any sort of refund.

When a commission is canceled before it is complete, the client may keep the incomplete art. I still hold the copyright to the art. The unfinished art may not be altered, or completed by another artist.

A 50% refund is available for commissions that don't exceed the concept stage.

You agree not to file a chargeback against me and in the instance that these terms are breached and a chargeback is filed, your right to any artwork I have made for you will be retracted.

I have the right to sell the copyrighted to new buyers-- I also reserve the right to collect any lost funds from unlawful chargebacks through whatever financial institution processed the fee AND/OR through legal proceedings.
